Hollywood actor cum comedian, Jamie Foxx, who is well known for his portrayal of Ray Charles in the film Ray is currently facing a sexual assault and battery charges lawsuit filed on Monday with the New York State Supreme Court.
The case which was filed under the New York’s Adult Survivor’s Act, provides a one-year window for sexual assault plaintiffs to file civil claims, regardless of the statute of limitations.
In the lawsuit, the plaintiff claims that the incident occurred in 2015 at Catch NYC, a popular New York City restaurant when a friend of the plaintiff asked the actor for a photo.
The plaintiff, identified as Jane Doe, alleged in the suit that Foxx seemed intoxicated at the time of the incident and had “intentionally and without consent used force to offensively touch Plaintiff’s person,” including groping her breasts and genitals after likening the plaintiff to Gabrielle Union, an american actress.
As a result of the sexual abuse, the complaint states the woman suffered and continues to suffer “physical and emotional injuries, anxiety, distress, embarrassment and economic harm,” and is seeking an compensation and punitive damages.
When Foxx escalated his alleged physical assault, court papers claim the plaintiff tried to get away. The alleged assault finally halted when the plaintiff’s friend rushed to her aid.
The Oscar-winner had a medical episode earlier this year after he was hospitalized in Atlanta for an undisclosed medical condition. He also addressed his recovery for the first time in July.
Jamie Foxx rose to limelight as a featured player in the sketch comedy show Living Colour until the show’s end in 1994.
He gained prominence for his film roles in Booty Call, Ali, Jarhead, Dreamgirls, Miami Vice and Horrible Bosses among others.
