Court Reserves Judgment in Nasarawa Governorship Election Appeal

Abuja — The Court of Appeal in Abuja has deferred its judgment in the appeal lodged by Nasarawa State Governor Abdullahi Sule challenging the tribunal’s verdict that declared David Ombugadu of the Peoples Democratic Party (PDP) as the winner of the state’s governorship election.

The tribunal, led by Justice Ezekiel Ajayi, delivered a split judgment asserting that Ombugadu secured the majority of valid votes at the election, based on evidence from various polling units. Governor Sule appealed the decision, contending that the tribunal misapplied the law.

During the hearing on Wednesday, Governor Sule’s counsel, Wole Olanipekun SAN, argued that the tribunal erroneously relied on the Bimodal Voter Accreditation System (BVAS) machine as evidence without proper demonstration by the petitioners or the court. Olanipekun maintained that the tribunal failed to identify overvoting in the Independent National Electoral Commission Form EC8AS presented by the petitioners.

In response, Kanu Agabi SAN, representing the PDP candidate, countered that the tribunal thoroughly analyzed the BVAS, contradicting Olanipekun’s assertions. Agabi argued that a court’s examination of exhibits renders the judgment fair.

Despite the time constraints, Kanu urged the court to dismiss the appeal, citing unexplored arguments.
