Court Affirms Kaduna Lawmaker’s Election Victory

The Court of Appeal in Abuja has recently upheld the election of Daniel Amos, the current representative of Jema’a/Sanga Federal Constituency in the National Assembly, after dismissing petitions challenging his victory in the February 25 poll.

In a unanimous decision, the three-member panel deemed the appeal brought forth by the All Progressive Congress (APC) candidate, Usman Anto, against Amos as lacking merit.

This decision has reinforced the earlier declaration by the Independent National Electoral Commission (INEC) of Amos as the rightful winner of the National Assembly elections.

Court to Hear State Assembly’s Appeal on Aiyedatiwa Ex Parte Order

Usman Anto and the APC had initially challenged Amos’s victory, filing a petition with the Kaduna State National and State Election Petitions Tribunal. However, their petition was dismissed for lack of merit by the tribunal, prompting them to appeal to the Court of Appeal on the grounds of alleged certificate forgery.

In the recent judgment, delivered by Justice Samuel Ademola Bolaji, the court firmly rejected the allegations of forgery against Daniel Amos, emphasizing the lack of substantial evidence presented by the appellant.

The justices censured Anto for relying solely on unproven accusations, highlighting the absence of concrete proof before both the tribunal and the Court of Appeal to substantiate the claims of forgery against the defendant.

Conclusively, the Court of Appeal emphasized that the evidence put forth by the appellant was insufficient and insufficient to overturn the election victory of Mr. Daniel Amos, thus affirming his position as the representative for Jema’a/Sanga Federal Constituency in the National Assembly.
