The Supreme Court on Friday affirmed Plateau State governor, Caleb Mutfwang of the Peoples Democratic Party (PDP), as duly elected and returned as Governor of the State in the 18th March Governorship poll.
The tribunal had unanimously affirmed Gov Mutfwang as Governor upon the petition of the All Progressives Congress APC Candidate, Goshwe Yilwatda Nentawe.
However, the Court of Appeal upturned the judgement and sacked the Governor, on the excuse that his party PDP lacked structure at the State Executive Committee level l.
Gov Mutfwang therefore approached the Apex Court who held that Plateau state high court order can’t affect PDP primaries because primaries are conducted by the National Executive Committee of the Party not the state.
The apex court stated that the court of Appeal lacked the jurisdiction to hear the issue of nomination.
Issue two resolved in favour of PDP stating that the APC members lacked locus standi in the internal affairs of another party.
Issue 3, whether judgment in Bitrus Kaze can stop the National Executive Committee NEC of the party from conducting primaries.
The Apex Court also had very harsh words for the Appeal Court for dabbling into matters it had no Jurisdiction over.
