Nigerian singer, Davido, has filed a primary objection to against the N2.3 billion breach of contract suit filed against his music label, Davido Music Worldwide Limited, by Brownhill Investments Company Limited and its Chairman, Amaju Pinnick.
It would be recalled that the former President of the Nigerian Football Federation (NFF), Pinnick had filed a N2.3 billion suit before the High Court of Delta State, Effurun, against Davido for an alleged breach of contract.
The claimants prayed to the court to award the amount as general damages against Davido after the singer failed to appear at the 19th edition of the “Warri Again” event on October 6, 2023  after collecting the sum of US$94,500 (an equivalent of N70million).
In his preliminary objection, Davido premised his response on the grounds that the case is a debt recovery matter as the claimant ought to have written a letter of demand first before rushing to court.
He reiterated that Sosoberokon isn’t his representative and doesn’t handle performance contracts on his behalf. Although he claimed non-payment for the show and disassociated Soso from being his agent, he acknowledged receiving $94,500, clarifying it was solely for promoting the event.
In the related criminal defamation case, Davido, represented by his legal team led by Mr. Norrison Quakers (SAN), contested the court’s jurisdiction. They argued that since the defamatory statements were online, the claimant failed to demonstrate that they were downloaded and viewed in Delta State, challenging the court’s jurisdiction.
The court has postponed both issues to December 14, 2023, awaiting a ruling on preliminary objections in each case. Additionally, in the defamation case involving N500 million against Israel, a staff member of Davido, Israel has not submitted a defense. The court has granted an injunction preventing Israel from making defamatory statements against Pinnick.
